DISCLAIMER OF LIABILITY FOR ANY USERS EXCEPT AVIATION USERS ( as defined under Paragraph 2.3.2 of the EGNOS Safety of Life Service Definition Document )

The European Union as the owner of the EGNOS system , the European Space Agency ( ESA ) as its design authority and ESSP SAS as its operator expressly disclaim all warranties of any kind ( whether express or implied ) with respect to the EGNOS Services and related Signal in Space ( SIS ) and data collected and generated by the EGNOS infrastructure , including , but not limited to the warranties regarding availability , continuity , accuracy , integrity , reliability, compatibility with a particular purpose or meeting the users' requirements . No communication, including advice or information , whether oral or written , obtained by a user from the European Union and/or ESA and/or ESSP SAS shall establish any such warranty .

When accessing and/or using the EGNOS Services and related SIS and data , the user agrees that neither the European Union nor ESA or ESSP SAS shall be held responsible or liable for any direct , indirect , incidental , special or consequential damages , including but not limited to , damages for interruption of business , loss of profits , goodwill or other intangible losses , resulting from the use of , misuse of or the inability to use the EGNOS Services, related SIS and data collected and generated by the EGNOS infrastructure .

The above Disclaimer of Liability does not apply to Aviation Users when accessing and/or using EGNOS Safety of Life (SoL) Service, related SIS and data collected and generated by the EGNOS infrastructure .

DISCLAIMER OF LIABILITY FOR AVIATION USERS

The European Union as the owner of the EGNOS system , the European Space Agency ( ESA ) as its design authority and ESSP SAS as its operator expressly disclaim towards Aviation Users all warranties of any kind ( whether express or implied ) with respect to the use of the EGNOS SoL Service and related SIS and data collected and generated by the EGNOS infrastructure , which are not strictly included in the EGNOS SoL Service Definition Document . No communication, including any advice or information , whether oral or written , obtained by an Aviation User from the European Union and/or ESA and/or ESSP SAS shall create any deviation from the conditions and limitations included in the EGNOS SoL Service Definition Document .

When accessing and/or using the EGNOS SoL Service and related SIS and data , the Aviation User agrees that neither the European Union nor ESA or ESSP SAS shall be held responsible or liable for any direct damage resulting from the use of , misuse of or the inability to use the EGNOS SoL Service , related SIS and data collected and generated by the EGNOS infrastructure , beyond the conditions and limitations of use set forth in the EGNOS SoL Service Definition Document ; or for any indirect , incidental , special or consequential damages , including but not limited to , damages for interruption of business , loss of profits , goodwill or other intangible losses , resulting from the use of , misuse of or the inability to use the EGNOS SoL Service, related SIS and data collected and generated by the EGNOS infrastructure .

- WARNING FOR SAFETY OF LIFE USERS OTHER THAN AVIATION USERS -

Neither EGNOS, its SIS , nor its operator have been certified for safety of life uses other than Aviation uses that have or could have an impact on the safety of human life and where a failure in availability, continuity, integrity or accuracy of the EGNOS SIS could cause any kind of direct or indirect personal damage, including bodily injuries or death .
